These Terms and Conditions (“Terms”) govern your use of the website peakautoacademy.com, the Peak Auto Academy community, and the services provided by Peak Auto LLC (“Peak Auto,” “we,” “us,” or “our”). By using this website, submitting a form, joining our community, or opting in to receive text messages from us, you agree to these Terms.
1. About Us
Peak Auto Academy is a brand of Peak Auto LLC, a Utah limited liability company. We publish educational content and operate an online community for people who are building and running vehicle rental businesses.
2. SMS Text Messaging Terms
2.1 Program Description
Peak Auto Academy operates a text messaging program that delivers educational content on building a profitable car-rental business, community and event updates, live call reminders, membership notifications, and occasional promotional offers.
By providing your mobile phone number and checking the applicable consent box on one of our forms, you agree to receive text messages from Peak Auto Academy at that number, including messages sent using an automatic telephone dialing system. Consent is optional and is not a condition of submitting a form, joining our community, or purchasing any goods or services from us.
We offer two separate types of messages, each with its own consent checkbox:
- Non-marketing (conversational and transactional) messages regarding your membership, account, scheduled community calls, replies to support questions, and follow-up on requests you submit through our website.
- Marketing and promotional messages regarding educational content, new resources, events, and membership offers.
You may consent to one, both, or neither. Opting in to one does not opt you in to the other.
2.2 Message Frequency
Message frequency varies based on your interactions with us. Conversational and transactional messages are sent as needed in response to your activity. Marketing messages, if you have opted in, are sent no more than 8 times per month.
2.3 Cost
Message and data rates may apply. These charges come from your mobile carrier and are your responsibility. Peak Auto LLC does not charge for text messages.
2.4 How to Opt Out
You can cancel at any time. Text STOP to (801) 316-8350 and we will send one confirmation message, after which we will not send you any further text messages. To rejoin, sign up again on peakautoacademy.com as you did the first time, or text START to the same number.

2.6 Carrier Liability
Carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your mobile carrier and is outside our control. Supported carriers include AT&T, Verizon Wireless, T-Mobile, US Cellular, and others. Carrier participation may change without notice.
2.7 Privacy
Information you provide in connection with our text messaging program is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
3. Eligibility
You must be at least 18 years old to use this website, submit a form, join our community, or opt in to receive text messages.
4. Membership
Peak Auto Academy offers both free and paid membership. Membership provides access to educational content, community spaces, and live calls, as described on our website at the time you join. The specific content, spaces, calls, and features included in each membership tier may change over time as the community develops.
Community access is delivered through a third-party community platform. Your use of that platform is also subject to that provider’s own terms and privacy policy.
We may suspend or terminate any membership, with or without notice, for conduct that violates these Terms or that is harmful to other members or to us.
5. Free Access Periods, Billing, Renewal, and Cancellation
Where we offer a free access period, the length and conditions of that period are stated at the time you sign up. If a free period converts to a paid membership, we will tell you that before it happens.
Paid membership is billed on a recurring basis at the price and interval shown at checkout, and renews automatically until you cancel. You may cancel at any time; cancellation takes effect at the end of your current billing period, and you keep access until then. Except where required by law, payments already made are non-refundable and we do not provide partial refunds for unused time.
We may change membership pricing. Any price change applies to billing periods that begin after we notify you.
6. No Earnings Guarantee
Any earnings figures, results, projections, or examples presented on this website, in our content, or in our community are illustrative only. They are not guarantees, offers, or promises of income. Results described by us or by other members reflect their individual circumstances and are not typical.
Your results depend on demand in your market, your pricing, vehicle selection and condition, utilization, capital, local regulation, your own effort, and many other factors outside our control. You are solely responsible for your business decisions and their outcomes.
7. Educational Content Only
Everything we publish and everything discussed in our community is educational and general in nature. It is not legal, tax, accounting, insurance, or financial advice, and it does not create a professional or advisory relationship. Vehicle rental businesses are subject to state and local law, insurance requirements, and platform rules that vary by location. Consult a qualified professional in your jurisdiction before acting.
8. Acceptable Use and Community Conduct
You agree not to use this website or our community to submit false or misleading information, to impersonate another person, to submit a phone number you are not authorized to use, to harass or abuse other members, to advertise or solicit without our permission, to interfere with the operation or security of the site or community, or to violate any applicable law.
9. Intellectual Property
The content on this website and in our community, including text, graphics, logos, photographs, video, templates, spreadsheets, and course material, is owned by or licensed to Peak Auto LLC. Your membership grants you a personal, non-transferable, revocable licence to use that material for your own business. You may not copy, republish, resell, share your login, or otherwise redistribute it without our written permission.
If you post content in our community, you keep ownership of it, and you grant us a non-exclusive licence to display it within the community and to quote it in our materials.
10. Third-Party Services and Links
Our website and community reference and link to third-party services, platforms, and tools. We do not control those services and are not responsible for their content, terms, availability, or practices. Any dealings you have with them are between you and them.
11. Disclaimers and Limitation of Liability
This website, our content, and our community are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Peak Auto LLC is not liable for any indirect, incidental, consequential, or punitive damages, or for any lost profits or business losses, arising out of your use of this website, our content, our community, or our messaging program.
12. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Salt Lake County, Utah.
13. Changes to These Terms
We may update these Terms from time to time. The Effective Date at the top reflects the most recent version. Continued use of the website or community after changes are posted constitutes acceptance of the updated Terms.
